1. Acceptance of Terms

By accessing or using ChooseLocal ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

2. Description of Service

ChooseLocal is a marketplace platform that connects local businesses, artisans, and makers with customers in their community. The Platform allows stall owners to create online storefronts and customers to discover local businesses.

Early Access Platform

ChooseLocal is in early development. Features may change, and we are actively improving the platform based on feedback from early supporters. By using the Platform, you agree to use the service as-is and understand that some features are still being built. We may add, modify, or remove features at any time without prior notice.

3. User Accounts

Account Creation

To access certain features, you must create an account using Google Sign-In. You agree to provide accurate information and keep your account secure.

Account Responsibilities

You are responsible for:

  • All activity that occurs under your account
  • Maintaining the security of your account credentials
  • Notifying us immediately of any unauthorised access

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in harmful behaviour.

4. Stall Owner Terms

Stall Creation and Content

As a stall owner, you agree that:

  • All information you provide about your business is accurate and not misleading
  • You have the right to use all content (images, text, logos) you upload
  • Your stall complies with all applicable laws and regulations
  • You will not use the Platform to sell illegal, harmful, or prohibited items

Subscription and Payment

To publish your stall and make it visible to customers, you must subscribe to a paid plan. By subscribing, you agree to:

  • Pay the subscription fees for your chosen plan (half-yearly or annual)
  • Automatic renewal of your subscription unless you cancel before the renewal date
  • Stripe's terms of service for payment processing

Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, your stall will remain live until the end of your current billing period. Refunds are handled on a case-by-case basis; please contact us for assistance.

5. Customer Terms

As a customer using the Platform to discover local businesses:

  • You understand that ChooseLocal is a discovery platform and does not process transactions between you and stall owners
  • Any purchases or agreements are made directly with the stall owner
  • ChooseLocal is not responsible for the quality, safety, or legality of goods or services offered by stall owners

6. Prohibited Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Post false, misleading, or deceptive content
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorised access to the Platform
  • Use automated systems to scrape or collect data
  • Interfere with the proper functioning of the Platform
  • Use the Platform for any illegal or unauthorised purpose

7. Content and Intellectual Property

Your Content

You retain ownership of content you upload to the Platform. By uploading content, you grant ChooseLocal a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your content in connection with the Platform.

Our Content

The Platform, including its design, features, and code, is owned by ChooseLocal. You may not copy, modify, or distribute our content without permission.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

As an early-access platform, we make no guarantees about feature availability or stability.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHOOSELOCAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ChooseLocal, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be resolved in the courts of Ireland.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
